Where do I get an Occupational Driver’s License?

A person gets an occupational driver’s license in the county where the person resides or where the offense occurred that caused the suspension. The exception to this rule is that after a person is convicted for a DWI. After a conviction, the verified occupational license petition must be filed with the clerk of the court in which the person was convicted and not in the person’s county of residence if it is different.

What are the Restrictions of an Occupational License?

Generally a person may not drive more than 4 hours every 24 hour period. If there is a showing of necessity a judge can extend the hours to 12 hours every 24 hour period. The license order for the licensee must specify the following:

  • the hours of the day and days of the week driving
  • the reasons for driving
  • the areas or routes of travel permitted

There is an advantage to having an Ignition Interlock Device. The licensee may not be subject to any time of travel, reason for travel, or location of travel restrictions.

What Happens if I Violate Occupational License Restrictions?

Driving outside of the restrictions can be a problem is stopped by law enforcement. Violation of Occupational License is a class B misdemeanor.

Sec. 521.253.  CRIMINAL PENALTY.  (a)  A person who holds an occupational license commits an offense if the person:(1)  operates a motor vehicle in violation of a restriction imposed on the license;  or(2)  fails to have in the person's possession a certified copy of the court order as required under Section 521.250.(b)  An offense under this section is a Class B misdemeanor.(c)  On conviction of an offense under this section, the occupational license and the order granting that license are revoked.

Can I get an Occupational License for a Commercial Driver’s License?

No an occupational driver’s license does not qualify to driver a commercial motor vehicle.
